These Terms of Conditions govern your access to and use of the Yal Travel Platform websites, mobile applications, and related services collectively, the “Services”. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Services.
If you use the Services on behalf of a company or other legal entity, you represent that you are authorized to accept these Terms on its behalf and that the entity agrees to be bound by them.
1. About Yal
Yal is a digital platform that allows users to discover, book, and manage trips, experiences, and travel services offered by third-party organizers, creators, guides, agencies, and other partners “Travel Providers”. Yal acts as an online intermediary only and is not a travel agency, tour operator, or transportation/accommodation provider.
All trips, experiences, and services are provided under the responsibility of the relevant Travel Provider.
2. Eligibility & Accounts
To use certain features of the Services, you must create an account and provide accurate, current, and complete information. You agree to:
Maintain and promptly update your information.
Keep your login credentials secure and confidential.
Be responsible for all activity that occurs under your account.
You must be at least the minimum legal age in your jurisdiction to enter into a binding contract, or have parental/guardian consent where required.
We may suspend or terminate accounts that violate these Terms or contain false, misleading, or incomplete information.
3. Bookings, Payments & Fees
When you book a trip, experience, or service through Yal:
You enter into a direct contract with the relevant Travel Provider.
Prices, inclusions, exclusions, and conditions are shown in the listing and are the responsibility of the Travel Provider.
Yal may process payments on behalf of Travel Providers via third-party payment processors.
You agree to:
Provide valid payment information and authorize us and our payment providers to charge you for bookings, fees, taxes, and any applicable charges.
Review all details (dates, inclusions, policies) before confirming a booking.
Cancellation, change, and refund policies are set by the Travel Provider and/or payment provider and may vary per booking. Yal is not responsible for decisions or delays in refunds made by Travel Providers or payment providers.
4. Yal’s Role & Responsibility
Yal:
Provides a platform to connect travelers and Travel Providers.
Does not guarantee the availability, quality, safety, legality, or accuracy of any trip, service, content, or Travel Provider.
Is not responsible for acts, omissions, or conduct of any user or Travel Provider on or off the platform.
You acknowledge that travel involves inherent risks, and your participation in any trip or experience is at your own discretion and risk.
5. User Conduct & Community
You agree not to:
Use the Services for any unlawful, fraudulent, or harmful purpose.
Post or share content that is defamatory, offensive, discriminatory, or violates any rights.
Attempt to bypass fees, payments, or contact Travel Providers or travelers to book outside the platform when introduced via Yal.
Interfere with the operation or security of the Services or attempt to access accounts or data without authorization.
We may remove content, suspend, or terminate accounts that violate these Terms or harm other users, Travel Providers, or Yal.
6. Content & Intellectual Property
Content on the Services includes text, photos, videos, logos, graphics, and other materials:
Content provided by Yal is owned by or licensed to Yal and protected by intellectual property laws. You may use it only as necessary to use the Services and may not copy, modify, distribute, or exploit it without written permission.
Content uploaded by users or Travel Providers (e.g., trip descriptions, photos, reviews) remains their responsibility.
By posting or submitting content on Yal, you grant Yal a worldwide, non-exclusive, royalty-free license to use, host, display, reproduce, and distribute such content in connection with operating and promoting the Services, in accordance with our Privacy Policy.
You represent that you have the necessary rights to upload and share any content you provide.
7. Third-Party Services & Links
The Services may include links to third-party websites, apps, payment services, or other tools. These are provided for convenience only, and Yal does not endorse or control them. Your use of any third-party service is at your own risk and subject to that third party’s terms and policies.
Yal is not responsible for any loss or damage arising from your dealings with third parties.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Yal disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that:
The Services will be uninterrupted, secure, or error-free.
Any content or listing is complete, accurate, or reliable.
Any trip or experience will meet your expectations.
9. Limitation of Liability
To the maximum extent permitted by law, Yal, its founders, employees, and partners will not be liable for any indirect, incidental, special, consequential or punitive damages or for any loss of profits, data or goodwill arising from or relating to your use of the Services or any trip or experience.
To the extent we are found liable, our total aggregate liability shall not exceed the amount you paid to Yal (in service fees, if any) in the twelve (12) months prior to the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
10. Termination
We may, at our sole discretion, suspend or terminate your access to the Services at any time, including if you:
Violate these Terms or any applicable law.
Engage in fraudulent, harmful, or abusive behavior.
Fail to pay any amounts due.
You may stop using the Services and request deletion of your account at any time, subject to our legal and business obligations.
Provisions intended to survive termination (such as disclaimers, limitations of liability, and intellectual property rights) will continue to apply.
11. Changes to the Services & Terms
We may modify or update the Services and these Terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date and, where appropriate, through the Services.
Your continued use of the Services after changes become effective means you accept the updated Terms. If you do not agree with the changes, you must stop using the Services.
12. Governing Law & Disputes
These Terms and your use of the Services are governed by the laws of State of Kuwait without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Kuwait, Farwaniya 92400 unless applicable law provides otherwise.
